BRIGHTHOUSE CABLE TELEVISON SERVICE


The Association have a bulk contract service with Brighthouse that is based upon all of the 120 Units on Bay Pointe paying for the service through their Association fees, however, if any Owner is delinquent in paying their Association fees or a property is in foreclosure, it means those owners who pay their fees are in effect subsidising, from the operational budget funding, the service of those who are not paying

Clearly this is unfair but equally it is now placing an unsustainable burden upon the Associations budgets and to that end we have been in negotiations with Brighthouse regarding the cancellation of the contract, which has a three year break clause include, that can now be exercised. The negotiations have now been concluded and we have reached an understanding with Brighthouse.

The understanding is for 12 months only after which it will have to be renegotiated. Brighthouse will now only charge the Association, at the bulk contract rate, for Units that are current with their Association Fees. This means that Owners who are foreclosed, in foreclosure, have had liens or intent to lien served on them, i.e. they are at least one quarter in arrears, will have the service to their Unit ‘cut off’ until their account is brought current

Effective 1st November 2008 all units that are,for the reasons above, delinquent with fees over an amount corresponding to one quarter will have their service terminated without further warning.

To have the service reconnected will require the Association to confirm to Brighthouse that the Owners account has been brought current including a reconnection charge, payable to the Association, of $50(fifty dollars)
